Unlocking TDR: A Vendor’s Guide to New Government Reporting Rules

Is Your Business Ready for TDR Changes? 

The recent introduction of the Transactional Data Reporting (TDR) rule has brought about a significant shift in the way vendors interact with the federal government. TDR now requires vendors to electronically report the actual prices paid by federal agencies for the goods and services acquired through GSA’s acquisition vehicles. This departure from the conventional pricing model is crucial to comprehend. 

Traditionally, the rules governing pricing with GSA have maintained that the negotiated price serves as a ceiling price. In practical terms, this means that vendors have the flexibility to extend additional discounts to GSA customers as they see fit. However, this practice has led to an ongoing challenge – tracking the actual cost paid for products and services versus the stated “GSA price.” This discrepancy has posed consistent problems for both contractors and the GSA. 

 

Benefits of TDR Participation 

For those opting to be part of the TDR pilot program, the reporting process will undoubtedly be more time-intensive. Rather than tracking the dollars per Special Item Number (SIN), vendors must now monitor the price for each specific product, necessitating a more detailed approach. Yet, the advantages of TDR participation are substantial. Notably, TDR eliminates the requirement for contractors in the pilot program to adhere to Commercial Sales Practices (CSP) and the arduous task of tracking the Price Reduction Clause. 

Once the modification is accepted, contractors participating in TDR will no longer be obligated to provide a CSP when submitting contract modifications and will be freed from the need to track their Basis of Award (BOA) customer. These changes bring forth a new era in contract administration. 

For contractors embracing the modification by December 31st, the new reporting rules will officially take effect on January 1st, marking a pivotal transition in their contractual processes.
