These Terms of Service (“Terms”) govern your access to and use of cap50.com (the “Site”) operated by Capitol 50 Consultants Inc (“Capitol 50,” “we,” “us,” or “our”). By using the Site, you agree to these Terms.

1) Who We Are

Capitol 50 Consultants Inc provides federal contracting consulting services, including GSA/VA schedule support and related guidance. (Capitol 50 Consultants)

2) Acceptance of Terms

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

3) Changes to Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised “Last Updated” date. Your continued use of the Site after changes means you accept the updated Terms.

4) Site Use and Eligibility

You agree that you will:

  • use the Site only for lawful purposes,
  • not misuse or attempt to disrupt the Site,
  • not attempt unauthorized access to accounts, systems, or data.

If you use the Site on behalf of a company, you represent you have authority to bind that company to these Terms.

5) Accounts (Members/Login)

If the Site offers an account or member area:

  • you are responsible for maintaining the confidentiality of your login credentials,
  • you are responsible for activities under your account,
  • you agree to provide accurate, current information.

We may suspend or terminate accounts that violate these Terms.

6) Consulting and No Guarantee

Information on the Site is provided for general informational purposes. Any consulting services you purchase or receive may be governed by a separate written agreement (e.g., statement of work, engagement letter, or contract).

No guarantee: Government contracting outcomes depend on many factors outside our control. We do not guarantee contract awards, approvals, timelines, revenue, or results.

No government affiliation: Capitol 50 is not a government agency and is not affiliated with the U.S. government.

7) Fees, Payments, and Refunds

If you engage us for paid services, fees and payment terms will be described in a separate written agreement or invoice. Unless otherwise stated in writing, all fees are non-refundable once work has begun.

8) User Submissions

If you submit information through the Site (e.g., contact form, uploads, messages):

  • you represent you have the right to provide it,
  • you grant us permission to use it to respond to you and to provide services,
  • you agree not to submit unlawful, defamatory, or infringing content.

9) Intellectual Property

The Site content (text, graphics, logos, designs, and other materials) is owned by or licensed to Capitol 50 and is protected by intellectual property laws. You may view and print pages for personal or internal business use only. You may not reproduce, distribute, or create derivative works without our written permission.

10) Prohibited Conduct

You agree not to:

  • reverse engineer, scrape, or crawl the Site in a way that harms performance or violates applicable law,
  • introduce malware or attempt to bypass security,
  • use the Site to harass, defraud, or infringe others’ rights,
  • impersonate any person or entity.

11) Third-Party Links and Tools

The Site may link to third-party websites or use third-party tools (e.g., scheduling or form processors). We do not control third-party services and are not responsible for their content or practices. Your use of third-party services is at your own risk.

12) Disclaimers

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPITOL 50 WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED $100.

(Some jurisdictions do not allow certain limitations; in that case, parts of this section may not apply to you.)

14) Indemnification

You agree to defend, indemnify, and hold harmless Capitol 50 from and against claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your submissions, or your violation of these Terms.

15) Termination

We may suspend or terminate your access to the Site at any time if we believe you have violated these Terms or if necessary to protect the Site, users, or our rights.

16) Governing Law and Venue

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. You agree that any dispute related to these Terms or the Site will be brought in state or federal courts located in Ohio, and you consent to personal jurisdiction there.

17) Miscellaneous

  • If any provision is found unenforceable, the remainder will remain in effect.
  • Our failure to enforce a provision is not a waiver.
  • These Terms, together with the Privacy Policy, constitute the entire agreement regarding your use of the Site (separate client service agreements are separate).
